Crossing and head on rules – problems and uncertainties

Specific Issues for discussion:
• Departing from the strict approach: “compelling necessity”, and to what extent can the crossing rules be “moulded” by circumstances?
• The “conundrum” of the stand-on vessel that caused the ships to cross.
• When are ships in a head on situation?
• Who should resolve all these uncertainties: the judge or the nautical assessors?
• How should decisions in the courts be conveyed to mariners?
• And hear how it all works in practice from a working pilot.
