The Second Cadwallader Memorial Lecture
The Civil Justice Reform, its Impact on Maritime Litigation, the Maritime Industry and London
7th July 1999
Given by Lord Justice Clarke and Mr Justice Rix
Chairman – Lord Mustill of Pateley Bridge (Chairman of the London Shipping Law Centre)
Held at Lloyd’s of London
When there is a force for change, there is no going back! As was analysed and predicted during this event, the Woolf Civil Justice Reform brought fundamental changes – inter-alia- in disclosure procedures, expert evidence and cost management.
The innovation of case management introduced flexibility and – by focussing litigants’ attention on the issues – has had the effect of increasing the settlement of disputes which, unwittingly, has reduced the development of maritime law for the sake of saving legal costs. A ‘double-edged sword’! What a price to be paid!
